in fuch affidavit or affidavits, fhall incur and be liable unto the fame penalties, as if fuch affidavit or affidavits had been made and taken in open court: which said several commissions shall be made out by the curfitor of the faid county palatine of Durham, upon a fiat or warrant from the faid chancellor of the faid county palatine of Durham, for taking affidavits in the faid court of chancery; and upon a fiat or warrant from any two of the juftices of the pleas, in their feffion of pleas, in and for the faid county palatine of Durham, for taking affidavits in the faid court of pleas: and the faid curfitor fhall caufe an entry to be made, in a book to be kept for that purpose, of the names of the perfons to whom fuch commiffions are from time to time granted, and the respective times when iffued; and the following fees each commif- fhall be paid for each commiffion, and no more, (to wit) the fum of two hillings for the fiat or warrant; the fum of four fhillings for making out the faid commiffion, befides the King's duty, and value of the parchment; and the fum of four fhillings for fealing the fame: and every commiffioner or person fo impowered fhall take and receive, for the fwearing of every affidavit before him in the faid court of chancery of Durham, the fum or fee of two fhillings, and no more; and for the fwearing of every affidavit before him in the faid court of pleas, in and for the faid county palatine of Durham, the fum or fee of one fhilling, and no more.

II. Provided always, and it is hereby declared, That fuch officers of the faid refpective courts of chancery and court of pleas, in the faid county palatine of Durham, as have heretotake affidavits fore taken or sworn affidavits, hall and may continue so to do, as heretofore. in the fame manner as if this act had not been made.

An act for continuing feveral acts of parliament made for the encouragement of the whale fishery carried on by his Majefty's fubjects.

HEREAS divers acts of parliament have been made for the encouragement of his Majesty's fubjects to carry on and improve the whale fishery, which, by the bounties given by the faid afts, did, till checked by the late war, greatly increafe, and by the continuance thereof, will fill further increase, to the great advan tage of the trade and navigation of these kingdoms; be it therefore enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this present parliament affembled, and by the authority of the fame, That an act made in the fifth year of the reign of his late majefty King George the Second, intituled, An act for encouraging the Greenland fibery, which was to continue in force for nine years from the twenty fifth day of December, one thoufand seven hundred and thirty one; and which act, by an act of parliament made in the thirteenth year of his faid late Majefty's reign, intituled, An a&t for continuing several laws therein mentioned relating to the premiums upon the importation of mafts,

yards, and bowfprits, tar, pitch, and turpentine; to British made fail cloth, and the duties payable on foreign fail cloth; to the Greenland, and to the whale fishery; for granting a further bounty for all fhips employed in the whale fishery during the prefent war; for exempting harpooners and others employed in the Greenland fishery trade, from being impressed; and for giving further time for the payment of duties omitted to be paid for the indentures and contracts of clerks and apprentices; was continued unto the twenty fifth day of December, one thousand seven hundred and fifty, and from thence to the end of the then next feffion of parliament; and which act, by an act of parliament made in the twenty fecond year of his 22 Geo. IL faid late Majefty's reign, intituled, An all for the further encouragement and enlargement of the whale fishery, and for continuing fuch laws as are therein mentioned relating thereto; and for the na turalization of fuch foreign proteftants as shall ferve, for the time therein mentioned, on board fuch fhips as fhall be fitted out for the faid fishery, was further continued unto the twenty fifth day of December, one thousand feven hundred and fifty feven, and from thence to the end of the then next feffion of parliament; and which act, by an act of parliament made in the twenty eighth 28 Geo. CAP. XXIII.

An act for raifing a certain fum of money by loans or Exchequer bills; and for applying certain monies remaining in the Exchequer, for the fervice of the year one thousand feven hundred and fixty four; and for application of certain favings of publick monies and of monies arifen by the Jale of military fores; and for further appropriating the Supplies granted in this feffion of parliament; and for relief of perfons who have omitted to infert in indentures, or other writings, the full fum agreed to be paid with clerks, apprentices, and other fervants.

Moft gracious Sovereign, WE, your Majefty's most dutiful and loyal fubjects, the commons of Great Britain in parliament affembled, for raifing the refidue of the neceffary supplies which we have chearfully granted to your Majefly in this feffion of parliament, have refolved to give and grant unto your Majefly the fums herein after mentioned; and do therefore moft humbly befeech your Majefty, that it may be enacted; and be it enacted by the King's moft excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That

Treafury impowered to take in loans, or iffue Exchequer bills, for any fum not exceeding 800,000l. in like manner as is prefcribed by the malt act of this feffion, concerning loans and Exchequer bills, thereby authorized to be taken and made. -Claufes, &c. in the faid act relating to loans or Exchequer bills, extended to this act. Exchequer bills fo iffued not to be tendred or received in payment of any of the publick taxes, before 6 April 1765; unless the fame thall be in courfe of payment before the faid day. The fame to be repaid out of the first fupplies which fhall be granted in the next feffion; or out of the finking fund, if no fupplies be granted before 5 July, 1765. Monies iffued for that purpose out of the finking fund, to be replaced out of the next fupplies. The bank impowered to advance on the credit of the faid loan, any fum or fums not exceeding 800,000l. the act 5 & 6 W. & M. notwithstanding.

And they are further impowered to iffue the fam of 3,497 1. 98. 9d. furplus of the duties upon beer, &c. granted by act 1 Geo. 3. to 5 fan. 1764; and furplus of 150,000l. granted the laft feffion, for paying and cloathing of the militia; remaining in the Exchequer. Alfo the fum of 102,469 l. 19 s. 3 d. 39. favings of the grant laft feffion, for pay of the Brunswick troops, fubfidies, and former grants, &c. and 61,0881. 4s. other favings; and by fale of stores in Germany and Portugal, to be applied towards the extraordinary expences of the land forces, &c. incurred to 5 Dec. 1763, not provided for. 170,906 1. 2 s. 8 d. favings upon the non-effective accounts of feveral regiments; to be applied towards the unfatiffied claims in Germany, reported to be due.The monies arifing by

An act for preventing frauds and abufes in relation to the fending and receiving of letters and packets free from the duty of postage.

Preamble. W poft letters by members of parliament, free from the WHEREAS, under colour of the privilege of fending and receiving

duty of poftage, many great and notorious frauds have been and fill are frequently practifed, as well in derogation of the honour of parliament, as to the detriment of the publick revenue; divers perfons having prefumed to counterfeit the hand, and otherwife fraudulently to make ufe of the names, of members of parliament, upon letters and packets to be Jent by the poft, in order to avoid the payment of the duty of poftage: and whereas the allowance of fending and receiving letters and packets free from the duty of postage, heretofore granted to, or customarily exercifed by, certain perfons not being members of parliament, in reSpect of their offices, has not been fufficiently confined to fuch letters and packets only as relate to the business of their respective offices, and may therefore, if continued without further reftrictions and limitations, be liable to great abuse: in order, therefore, to put the more effectual stop to thefe and the like frauds and abufes, and at the fame time to afcertain, for the better guidance and direction of his Majesty's post master general, and the officers to be employed under him, in the performance of their duty, by what perfons only, and under what regulations or restrictions, the privilege or allowance of fending and receiving letters and packets free from the duty of poftage fhall thenceforth be enjoyed and exercised
