nor more than one hundred dollars, and may, at the discretion of the court or Justice trying the case, be confined in jail for a period not exceeding thirty days. Any justice of the peace of the county wherein the offense was committed shall have concurrent jurisdiction of such offense with the circuit or other courts of such county.

The words, "flag, standard, color or ensign of the United States," as used in this section, shall be construed to include any flag, standard, color, ensign or any representation or picture of a flag, standard, color or ensign, made of or upon any substance whatever, and of any size whatever, showing the national colors, the stars and the stripes.

This section shall not apply to any act permitted by the statutes of the United States or of this state, or by the regulations of the United States army and navy, or of the national guard of this state; or of the members of the department of public safety; nor shall this section be construed to apply to the regular issue of a newspaper or other periodical, or to any book, certificate, diploma, warrant or commission on which shall be printed said flag, disconnected from any advertisement, or to the vignette of any political ballot.

WISCONSIN STATUTES, 1939

348.479. Improper Use of State or United States Flag or other Symbol of Authority. No person shall, in any manner for exhibition or display:

(1) Place or cause to be placed any word, figure, mark, picture, design, drawing or advertisement of any nature upon any flag, standard, color, ensign or shield of the United States or of this state, or authorized by any law of the United States or of this state; or

(2) Expose to public view any such flag, standard, color, ensign or shield upon which shall have been printed, painted or otherwise produced, or to which shall have been attached, appended, affixed or annexed any such word, figure, mark, picture, design, drawing or advertisement; or

(3) Expose to public view for sale, manufacture, or otherwise, or to sell, give or have in possession for sale, for gift or for use for any purpose, any substance, being an article of merchandise, or receptacle, or thing for holding or carrying merchandise, upon or to which shall have been produced or attached any such flag, standard, color, ensign, or shield, in order to advertise, call attention to, decorate, mark or distinguish such article or substance.

348.48. Same: Mutilation; Disrespect.-No person shall publicly mutilate, deface, defile, defy, tramply upon, or by word or act cast contempt upon any such flag, standard, color, ensign or shield.

348.481. Same; Exceptions.-Sections 348.482 and 348.483 shall not apply to any act permitted by the statutes of the United States or of this state, or by the United States army and navy regulations, nor shall it apply to any printed or written document or production, stationery, ornament, picture or jewelry whereon shall be depicted said flag, standard, color, ensign or shield with no design or words thereon and disconnected with any advertisement.

348.482. Same; Definitions.-The words flag, standard, color, ensign or shield, as used in sections 348.479 to 348.481 shall include any flag, standard, color, ensign or shield, or copy, picture or representation thereof, made of any substance or represented or produced theron, and of any size, evidently purporting to be such flag, standard, color, ensign or shield of the United States or of this state, or a copy, picture or representation thereof.

348483 Same; Penalty-(1) Any person violating the provisions of section 348479 shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than ten dollars nor more than one hundred dollars.

(2) Any person violating the provisions of section 348.48 shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than ten dollars nor more than one hundred dollars or by imprisonment in the county jail not more than sixty days or by both such fine and imprisonment in the discretion of the court.

348.484. Same; Interpretation.-Section 348.479 to 348.484 shall be so construed as to effectuate its general purpose and to make uniform the laws of the states which enact them.

348.485. Display of Red Flag.-(1) It shall be unlawful for any person to display or exhibit at any meeting, gathering, or parade, public or private, the red flag or any other flag, banner or emblem, symbolizing or intended by the person or persons displaying or exhibiting the same, to symbolize a purpose to overthrow, by force or violence, or by physical injury to personal property, the government of the United States, or of the state of Wisconsin, or all government. Provided, that nothing in this section shall be construed as authorizing any of the things prohibited in section 348.479 to 348.484.

(2) Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and shall, upon conviction, be fined not less than ten dollars nor more than one hundred dollars with cost of prosection and, in default thereof, by imprisonment in the county jail not to exceed thirty days.

SECTION 7282. Desecration of the Flag.-Any person who, in any manner, for exhibition or display, puts or causes to be placed any inscription, design, device, symbol, portrait, name, advertisements, words, characters, marks or notices whatever upon any flag or ensign of the United States, or state flag of this state or ensign evidently purporting to be either of said flags, or ensign, or who, in any manner appends, annexes or affixes to any such flag, or ensign any inscription, design, device, symbol, portrait, name, advertisement, words, marks, notices or token whatever, or who displays or exhibits or causes to be displayed or exhibited, any flag or ensign, evidently purporting to be either of said flags, upon which shall, in any manner be put, attached, annexed or affixed any inscription, design, device, symbol, portrait, name, advertisement, words, marks, notice or token whatever, or who publicly or willfully mutilates, tramples upon, or who tears down or willfully and maliciously removes while owned by others, or otherwise defaces or defiles any of said flags or ensign, which are public or private property, shall be deemed guilty of a misdemeanor, and shall, on conviction thereof, be punished by a fine not exceeding two hundred and fifty dollars or imprisoned not exceeding one year, or both; provided, however, that this section shall not apply to flags or ensigns the property of or used in the service of the United States or of this state, upon which inscription, names of actions, words, marks or symbols are placed pursuant to law or authorized regulations.
