W.P. and his Affigns, into the faid Premiffes, or into any Part thereof, to enter and diftrain, and the Distress and Diftreffes then and there found to take, lead, drive, carry away and impound, and the fame in Pound to detain and keep, until the fame Annuity and the Arrears thereof, (if any fhall happen to be) together with all Cofts and Charges thereabout, fhall be fully paid and fatisfy'd. And the faid E. A. for himfelf, his Heirs and Affigns, doth covenant and grant to and with the faid W.P. his Executors, Adminiftrators and Affigns, That he the faid E. A. his Heirs or Affigns, fhall and will well and truly pay or cause to be paid unto the faid W. P. or his Affigns, the faid Annuity or yearly Rent-Charge of &c. abovementioned, at the Days and Times, and in Manner and Form above expreffed, according to the true Intent and Meaning of these Prefents. And alfo, That the Meffuages, Lands, Tenements and Hereditaments above mentioned, to be charged or chargeable with the faid Annuity or yearly Rent-Charge hereby granted, fhall from Time to Time be and continue overt and fufficient for the Payment of the faid Annuity yearly, du ring the Life of the faid W. &c. of the one Part, and J. C. of, &c. of the other Part: Witneseth, That the faid R. F. in Confideration of, &c. Hath given and granted, and by thefe Prefents doth, &c. to the faid J.C. One Annuity or yearly Rent of &c. to be

iffuing out of all that the Manor, &c. To have, hold, take and receive the faid Annuity or yearly Rent of, &c. to the faid J.C. and his Affigns, from henceforth, for and during the Term of the natural Life of the faid J. C. To be yearly paid to the faid J. C. or his Affigns, during the Life of the faid J. C. at &c. on &c. the first Payment thereof to begin on &c. next coming. And if it fhall happen the said Annuity or yearly Rent of Ec. or any Part thereof, to be behind and unpaid, in Part or in all, by the Space of, &c. next after either of the faid Days or Times for Payment thereof, and whereon the fame fhould or of Right ought to be paid as aforefaid; that then for every fuch Default of Payment thereof, or of any Part thereof, the faid R. F. his Heirs and Affigns, fhall forfeit and lose to the faid J. C. his Executors and Affigns, the Sum of, &c. in Nomine Pune. And alfo, That then and at all Times, fo often as any fuch Default fhall happen, from thenceforth it shall and may be lawful to and for the faid J.C. his Executors and Affigns, into the faid Manor of &c. with the Appurtenances, or into any Part thereof, to enter and diftrain, as well for the faid Annuity and yearly Rent, and all Arrearages thereof, as alfo for all and every Pain and Pains aforefaid, fo to be forfeited as aforefaid, and all Arrearages thereof, and all and every fuch Diftrefs and Diftreffes in and upon the Premiffes, or any Part thereof, to be found, lawfully and quietly to take, lead, drive and carry away, and detain and keep, until the faid Annuity or yearly Rent, and Pain and Pains aforefaid, and all Arrearages thereof, together with their Cofts and Damages in that Behalf to be fuftained, fhall be fully paid and fatisfy'd.

fatisfy'd. And the faid R. F. for himself, his Heirs and Affigns, doth covenant and grant to and with the faid J. C. his Executors, Adminiftrators and Affigns, That the faid Manor and Premiffes above mentioned, fhall remain, continue and be at all Times hereafter chargeable with, and liable to, all and every the Distress and Diftreffes of the faid J. C. and his Affigns, there to be had and taken at any Time for Default of Payment of the faid Annuity, and Pain and Pains aforefaid, to be forfeited as aforefaid, or any Part thereof, according to the Purport and true Intent and Meaning of these Presents. And alfo, That during the natural Life of the faid J. C. the faid Manor and Premiffes fhall be and continue of the clear yearly Value of, &c. over and above all Reprises. And that he the faid R. F. now is true and lawful Owner of the faid Manor of &c. with the Appurtenances, of a good, lawful and indefeazable Eftate of Inheritance in Fee-Simple. And further, That the faid R. F. and his Heirs, if it fhall be found hereafter that the Affurance of the faid Annuity by these Presents made fhall not be a full and fufficient Affurance thereof to the faid J. C. that then, upon Notice thereof given, and Request made to the faid R. F. or his Heirs, by the faid J.C. or his Affigns, the faid R. F. and his Heirs fhall, at his and their own Cofts and Charges in the Law, make all and every such further and other Affurance and Affurances to the faid J. C. of the faid Annuity for the Term of his natural Life, as by him the faid J.C. or his Counfel learned in the Law, fhall be reafonably devised, advised and required. In Witness, &c.

A Grant

A Grant of an Annuity on Condition, in the Nature of a Mortgage.

This Indenthe one part, and R. D. of Uc. of His Indenture made, &c. Between J. J. of, of one the other Part: Witneffeth, That the faid J.I. for and in Confideration of the Sum of, &c. to him in Hand paid by the faid R.D. at and before the Sealing and Delivery of thefe Prefents, the Receipt whereof the faid J. I. doth hereby acknowledge; he the faid J. I. Hath given and granted, and by these Prefents doth give and grant unto the faid R. D. one Annuity or yearly Rent of, &c. iffuing and going out of All thofe Meffuages, Lands, Tenements and Hereditaments, lying and being in, &c. aforefaid, now in the Tenure of, &c. and out of all other the Lands, Tenements and Hereditaments whatfoever of him the faid J. I. in, &c. aforefaid; To have, hold and enjoy the faid Annuity or yearly Rent of, &c. and every Part and Parcel thereof, to the faid R. D. his Heirs and Affigns, To the only proper Ufe and Behoof of the faid R. D. his Heirs and Affigns for ever, Payable and to be paid at the Feafts of, &c. yearly, by even and equal Portions. And if it fhall happen the faid yearly Rent of, &c. or any Part thereof, to be behind and unpaid after any of the faid Feafts or Days of Payment on which the fame ought to be paid as aforefaid; then it fhall and may be lawful to and for the faid R. D. his Heirs and Affigns, into the faid Meffuages, Lands, Tenements and Hereditaments, and into every or any Part thereof to enter and diftrain, and the Diftrefs and Diftreffes there found, to lead, drive and carry away, and impound and detain, until

he or they shall be of the faid Annuity or yearly Rent fo being behind, and the Arrearages thereof (if any be) fully fatisfied, contented and paid. And the faid J.I. for himself, his Heirs, Executors and Adminiftrators, doth covenant, and Grant, to and with the faid R. D. his Heirs, Executors, Adminiftrators and Af figns, That he the faid J. I. is and ftandeth feized of and in the Meffuages, Lands, Tenements and Hereditaments in, &c. aforefaid, at the Time of Delivery of these Presents, of the clear yearly Value of, &c. over and above all Charges and Reprizes, of a good and perfect Eftate in Fee Simple; And that he hath in himfelf full Power and lawful Authority to charge the fame with the faid Annuity or yearly Rent of, &c. in Manner aforefaid; And that the fame Meffuages, Lands, Tenements and Hereditaments, fhall be at all Times hereafter overt, and fubject to the Diftreffes of the faid R.D. his Heirs and Affigns, when he or they shall come to diftrain for the faid Rent, or any Part thereof behind. And that he the faid J.I. his Heirs, Executors, Adminiftrators and Affigns, fhall and will at all Times hereafter keep, acquit, difcharge or fave harmless the faid Meffuages, Lands, Tenements, Hereditaments and Premiffes above mentioned, and every Part thereof, of and from all Manner of Bargains, Sales, Jointures, Dowers, Statutes, Judgments, and all other Titles, Charges and Incumbrances whatfoever, in fuch Manner that the faid R. D. his Heirs and Affigns, fhall and may have and enjoy the faid Annuity or yearly Rent of, &c. and every Part thereof, for ever peaceably and quietly, without any lawful Let or Interruption of any Perfon or Perfons whatsoever.
