statute, or any claufe, matter or thing contained therein to the contrary notwithstanding. f. 185. X. And whereas in and by an act of parliament made and passed in the tenth year of her Majefty's reign, for laying duties upon foap, and other matters therein mentioned, it was amongst other things enacted, That it should and might be lawful to and for the refpective treasurers of the navy and ordinance, and the respective paymasters of Clause to ena the guards, garrifons and land forces for the time being, or any other ble the bank officers or perfons, who then were or afterwards fhould be entitled (for and others, to of England, the publick ufe and benefit) to any parts or feares of the capital ftock of advance mo the corporation erected by the name of the governor aud company of ney on South merchants of Great Britain, trading to the South Seas and other Sea stock. 10 Ann. c. 19. parts of America, and for encouraging the fishery (not being abfolutely fold, applied or disposed for some of the publick ufes in that att mentioned) from time to time, by any warrant or warrants in writing from the high treasurer of Great Britain then being, or the high treafurer of Great Britain, or any three or more of the commiffioners of the treasury for the time being, (and not otherwise) to borrow any fum or fums of money, from any person or perfons, natives or foreigners, bodies politick or corporate, who were or fhould be willing to advance or lend the fame upon credit of the said publick flock, or any part thereof, and to allow intereft, not exceeding the rate of fix pounds per cent, per ann. for the forbearance thereof, as is therein mentioned, and to affign, mortgage, and transfer fuch respective shares of the faid ftock, whereupon fuch fums of money fhould be agreed to be fo lent, to the respective lenders thereof, or fuch as they severally and respectively fhould appoint, and to their executors, adminiftrators, fucceffors and affigns refpectively, upon fuch conditions of redemption, and under fuch agreements for the fale of the flock fo mortgaged, for making default in the repayment of the money to be borrowed thereupon, or for non-payment of the intereft thereof, and fubject to fuch other conditions, and in fuch manner and form, as in fuch warrant and warrants respectively fhould be prescribed in that behalf; and that all the money which should be borrowed upon credit of fuch stock, as aforefaid, fhould be applied and difpofed by the faid treasurers, paymafters, or others refpectively chargeable therewith, to fuch publick ufes whereunto the faid ftock fo to be mortgaged would have been applicable by or in pursuance of another act in the faid recited act mentioned, if no fuch mortgage, affignment or transfer had been made, and to no other use, intent or purpose whatsoever; and that the said treafurers, paymasters, and other officers, borrowing the faid monies, fbould be anfwerable for the application thereof accordingly; and that the faid company fhould not be refponfible for permitting the flock to be fo transferred, as if the fame were unduly transferred; and that the Lenders of fuch money fhould not be chargeable with the application thereof to the faid ufes, as by the faid act of the tenth year of her Ma- to Ann. c. 19, jefty's reign may more fully appear: and whereas fome doubt hath been made, whether the governor and company of the bank of England (with regard to certain reftrictions contained in former acts of parliament) might lawfully lend money upon credit of the said publick Stock, pursuant to the faid act in that behalf: for obviating of 6 which which doubt, it is declared and enacted by this present act, That it fhall and may be lawful, as well to and for the governor and company of the bank of England, as to and for any other person or perfons, natives and foreigners, bodies politick or corporate, to advance and lend fuch fum and fums of money, as they, or any of them, fhall think fit, to the faid treasurers, paymasters, and others, or any of them, upon credit of the publick stock before mentioned, or any part thereof, at such intereft, and upon fuch affignments, mortgages or transfers, fubject to fuch conditions of redemption, and with fuch agreements for felling the stock fo mortgaged, in cafe of non-payment of the principal or intereft, and in all other refpects according to the forms prescribed in the said recited act of parliament in that 10 Ann. c. 19. behalf; any former act or acts of parliament, or any reftrictions, prohibitions, penalties, forfeitures, claufes, matters or things therein contained to the contrary in any wife notwithftanding. 1.33. An all for taking away the new additional duty of thirty pounds per centum ad valorem, impofed upon all books and prints imported into Great Britain, by an act made in the tenth year of the reign of her prefent majesty Queen Anne. 10 Ann. c. 19. WHEREAS by divers als of parliament heretofore made, several duties have been laid upon all books and prints imported into Great Britain: and whereas by an act made in the tenth year of the reign of her prefent majesty Queen Anne, a further duty of thirty pounds per centum ad valorem was laid upon all books and prints imported into Great Britain; which faid additional duty of thirty pounds per centum has been found, by experience, to have tended very much to the difcouragement of learning, and to have been prejudicial to the other duties formerly laid: be it therefore enacted After 24 June by the Queen's most excellent majefty, by and with the advice 1714, the duty and confent of the lords fpiritual and temporal and commons, of 30l. per in this prefent parliament affembled, and by the authority of cent. ad valothe fame, That from and after the four and twentieth day of June one thousand seven hundred and fourteen, the faid duty of thirty pounds per centum ad valorem fhall not be charged, levied, or collected upon any books or prints imported into Great 10 Ann. c. 19. W HEREAS by an act of parliament paffed in the one and 21 H. 8. c. 61 twentieth year of the reign of the late King Henry the fect. 7. Eighth, intituled, An act where mortuaries ought to be paid, for what perfons, and how much, and in what cafe none is due, and by a provifo or claufe therein contained, it is provided (among other things) That it shall be lawful to the bishops of Bangor, Lan daff, St. Davids, and St. Alaph, to take fuch mortuaries of the priests within their diocefes and jurifdictions as thentofore had been accustomed; and the bishops of the faid diocefes for the time being have accordingly used to demand and take, and continue to demand and take mortuaries upon the death of any clergyman within their faid diocefes and jurifdictions; which faid mortuaries confifting of feveral of the best goods of the deceased, do oftentimes amount to a very confiderable part of his eftate, and the payment thereof does very much leffen that fmall provifion which generally the clergy of thofe dioceses are able to make for the fupport of their families, and tends to the great impoverifbing of the fame for the remedying whereof for the future, and for abolishing and taking away all mortuaries or corfe-prefents, and the custom or ufage of taking and paying mortuaries or corfe-prefents upon the death of clergymen within the faid diocefes and jurif dictions and to the end a reasonable recompenfe and fatisfaction for the fame may be provided and eflablished for the bishops of the faid diacafes for ever be it therefore enacted by the Queen's most ex- The clause in cellent majefty, by and with the advice and confent of the the recited lords fpiritual and temporal and of the commons, in this prefent act, fo far as it parliament affembled, and by the authority of the fame, That taking any the faid provifo or claufe in the faid act, and all and every mortuary in provife or claufe in the fame act, fo far as the fame do or doth the diocefes of relate to the taking any mortuary or corfe-prefent upon the Bangor, Lana death of any clergyman within the faid refpective diocefes or vid's, and daff, St. Dajurifdictions, fhall immediately, from and after the refpective st. Recompenfe to the bishop of St. Afaph and his fuccef fors, for fuch mortuaries. the faid diocese of Landaff, immediately from and after such time as the treasurership, with the prebend thereto annexed, founded in the cathedral church of Landaff, fhall next happen to be void, fuch treasurership and prebend being in the collation of the bishop of the faid diocese of Landaff; and within the faid diocefe of St. Davids, immediately from and after fuch time as the prebend of Langamarch, founded in the collegiate church of Brecon, now enjoyed by John Medley, archdeacon of St. Davids, fhall next happen to be void, the fame being in the collation of the bishop of St. Davids, stand and be abfolutely repealed, annulled, and void, and all and every, and any custom, and ufage of and for paying, demanding, or taking any mortuary or corfe-prefent, or any goods, thing or things, for or in the name of a mortuary or corfe-prefent, upon the death of any clergyman within the faid refpective diocefes or jurifdictions, fhall, from the refpective times aforefaid, for ever, be abfolutely abolished and void; and no mortuary or corfe-present, or fum or fums of money for or in lieu of the fame, or in the name thereof, fhall be yielded, paid, answered or fatisfied, or be due or payable by any perfon or perfons, to any bishop of either of the faid diocefes, or other perfon or perfons claiming by, from, or under any fuch bishop: and that from and after the respective times aforefaid, it shall not be lawful to or for the refpective bishops of the faid diocefes, or any of them, their, or any, or either of their fucceffors, farmers, bailiffs, or leffees, or any of them, or any other perfon or perfons whatsoever, claiming by or under fuch bishops, or any or either of them, to take, receive, or demand of any perfon or perfons, any manner of mortuary or corfe-prefent, or any fum or fums of money, or other thing, for or in the name, lieu or ftead of any mortuary or corfe-prefent, or to convene, cite, fue or profecute any perfon or perfons before any judge fpiritual, or in any of her Majefty's courts of law, or other court whatsoever, for the recovery of, or for, touching or concerning any mortuary or corfeprefent, or any thing in lieu thereof, for or by reason or on account of the death of any prieft or clergyman within the said refpective dioceses or jurifdictions, at any time after the respective times aforefaid; any thing in the said recited act, or any law, custom or usage whatever, to the contrary notwithstanding. II. And be it further enacted by the authority aforefaid, That in recompenfe and fatisfaction to the bithop of St. Asaph and his fucceffors, for fuch mortuaries as might arife or become due or payable to the faid bishop of St. Ajaph, or his fucceffors, by virtue of the faid recited act, upon the death of any prieft or clergyman, the rectory fine cura, which shall first after the faid four and twentieth day of June one thousand seven hundred and fourteen, happen to be void, and be in the collation of the bishop of the faid diocefe of St. Asaph, or any of his fucceffors, fhall immediately upon fuch vacancy, and from thenceforth be annexed and united to the faid bishoprick of St. Ajaph for ever, and all and every the profits, rights, dues, benefits and and advantages whatsoever of the fame rectory, or thereto in any wife belonging or appertaining, fhall or may be had, received, taken and injoyed by the bishop of the faid diocese and his fucceffors for ever.
