XXV. And be it enacted by the authority aforefaid, That 81,000l. to be yearly and every year, during the term of thirty two years, reck- the yearly oning the first year to begin from the twenty ninth day of September, one thousand seven hundred and ten, the full fum of eighty one thousand pounds per annum, by or out of the monies to arife by the faid rates, duties, and fums of money by this act granted, or chargeable, and to be brought into the receipt of Exchequer, as aforefaid, in cafe the fame fhall extend thereunto, fhall be the whole and entire yearly fund; and in cafe all the monies arifing into the Exchequer, of or for the faid rates and duties, fhall not amount to eighty one thousand pounds per annum, then the monies so arifing, fo far as the fame will extend, fhall be part of the yearly fund for or towards the answering or paying of all the several and refpective annuities herein after mentioned; and in cafe the faid rates, duties, and fums of money by this act Deficiency to granted, fhall at any time or times appear to be so deficient or low be made good in the produce of the fame, as that within any one year to be out of the furreckoned, as aforefaid, the faid monies arifing into the Exche- plus of coals quer, for or upon account of the fame rates and duties fhall not act; amount to fo much as eighty one thousand pounds, or to fo much as fhall be fufficient to discharge and fatisfy all the annuities by this act appointed or intended to be paid within or for the fame year respectively, That then and so often, and in every such cafe, fo much as fhall be deficient or wanting to make up the faid fund for every or any fuch year, shall be supplied and made good from time to time out of the furplus or remainder of the monies which, for fuch year respectively, fhall arife by the rates and duties granted by an act of this feffion of parliament, intituled, An act for continuing part of the duties on coals, culm, and cynders, and granting new duties upon boufes having twenty windows or more, to raise the fum of fifteen hundred thousand pounds, by way of a lottery, for the fervice of the year one thousand seven hundred and ten, after all the annuities, charges and payments directed or authorized by that act, until the end of fuch year respectively, fhall be fully fatisfied, paid, and discharged, or monies fufficient fhall be referved for that purpose (which furplus or remainder was referved to be difpofed by authority of parliament;) and in default of fuch furplus or remainder, then the faid deficiency fhall be supplied or made up from time to time out of the first aid to be granted in parliament, next after fuch deficiency fhall and in default, appear, and shall from time to time be transferred thereunto, by parliament. as foon as fuch aid fhall be granted.

XXVI. And it is hereby declared, That so much of the faid Duties arifing duties hereby granted, as fhall come into the Exchequer before before 29 Sept. the twenty ninth day of September, one thousand seven hundred 1710. to be applied to the and ten, fhall go in aid of the faid yearly fund after the faid annuities, &c. twenty ninth day of September, one thousand feven hundred and ten, for payment of the annuities which shall become payable upon this act.

XXVII. And it is hereby enacted, That all the monies arifing

Monies arifing by the duties hereby granted, and provifions hereby made for by the duties to be entred in payment of the feveral annuities which fhall be payable upon this act, fhall be fairly and duly entred in one or more book or books to be kept in the offices of the auditor of the receipt, and clerk of the pells, for that purpose, to which all perfons concerned, at all feasonable times, fhall have free accefs, without fee or charge. XXVIII. And for the raifing any fum or fums of money, not exceeding in the whole the fum of nine hundred thousand pounds, for carrying on the faid war, and other her Majesty's occafions; it is hereby further enacted by the authority aforefaid, That it fhall and may be lawful to and for any perfon or perfons, natives or foreigners, bodies politick or corporate, to contribute, advance, and pay into the receipt of her Majefty's Exchequer, for her Majefty's use, at or before the refpective days and times in this act limited in that behalf, any fum or fums of money, not exceeding in the whole the faid fum of nine hundred thousand pounds, for the abfolute purchase of any certain annuity or annuities, to be paid and payable, during the full term of thirty two years, to be reckoned from the twenty ninth day of September, in the year of our Lord one thousand seven hundred and ten; which certain annuities fhall be computed at the rate of nine pounds per annum for every one hundred pounds, and proportionably for any greater fum fo to be advanced or paid; and the purchase-money for every fuch annuity, at the rate aforefaid, is hereby appointed to be paid into the faid receipt of Exchequer, at or before the refpective days and times herein after limited; Times of pay- that is to fay, one fourth part thereof on or before the first day of May, in the year of our Lord one thousand seven hundred and ten; one other fourth part thereof on or before the first day of July, in the year of our Lord one thousand seven hundred and ten; one other fourth part thereof on or before the first day of September, in the year of our Lord one thousand feven hundred and ten; and the remaining fourth part thereof on or before the first day of November, in the year of our Lord one thousand seven hundred and ten: all which annuities fo to be purchased, fhall not exceed in the whole the fum of eighty one thousand pounds per annum, and fhall be paid and payable at the four most ufual feafts, or days of payment in the year; that is to say, the feafts of the birth of our Lord Chrift, the annunciation of the bleffed virgin Mary, the nativity of St. John Baptift, and St. Michael the archangel, by even and equal portions; the firft payment thereof to be due at the feat of the birth of our Lord Chrift, which fhall be in the year of our Lord one thousand seven hundred and ten.

respectively to be purchased, according to the tenor and true
meaning of this act; and that all the faid annuities to be purchased
on this act, and every of them, during the term aforefaid, shall
be free from all taxes, charges, and impofitions whatsoever.
XXXI. And be it further enacted by the authority aforesaid, to have tallies
That every contributor upon this act, for any fuch annuity or truck,
annuities, as aforefaid, his, her, or their executors, adminiftra-
tors, fucceffors, or affigns, upon payment of the confideration
or purchase-money for the fame, at the rate aforesaid, or any
part or proportion thereof, into the faid receipt of Exchequer,
within the time or times in this act limited in that behalf, shall
immediately have one or more tally or tallies levied, importing
the receipt of fo much purchase-money as shall be so paid; and
upon payment of all the purchase-money, for any fuch annuity
or annuities, at the rate aforefaid, every fuch contributor, his, her,
or their executors, adminiftrators, fucceffors or affigns refpective-
ly, fhall have an order for paying of the faid annuity and annui-
ties, for and during the faid term of thirty two years to be pur-
chased therein; which order fhall be figned by the treasurer and and orders
under treasurer of the Exchequer, or any three or more of the figned by the
commiffioners of the treasury for the time being; and after the treasurer, &c
figning thereof, the fame fhall be firm, good, valid, and effectu-

al in the law, according to the purport and true meaning there-
of, and of this act; and fhall not be determinable by or upon
the deaths or removal of any treasurer or under treasurer of the
Exchequer, or any commiffioner or commiffioners of the treafu-
ry, or by or upon the determination of the power, office, or offices
of them, or any of them; nor fhall any lord high treasurer of
Great Britain, treasurer of the Exchequer, or any commiffioners

XXXII. And for the encouragement of the contributors to advance and pay readily into the receipt of the Exchequer, the fums by them intended to be advanced upon this act, it is provided and enacted by the authority aforefaid, That every fuch contributor who fhall advance and pay into the faid receipt of Exchequer, within the times limited by this act, the purchasemoney payable for any fuch annuity or annuities, as aforefaid, his, her, or their executors, adminiftrators, fucceffors, or affigns, fhall be allowed and paid out of the contribution-money arifing by this act, intereft after the rate of eight pounds per centum per annum, for the prompt payment of the purchase-money, or of fuch proportions of the purchase-money as fhall be fo advanced before the nine and twentieth day of September, one thousand feven hundred and ten; the faid intereft to be computed for the respective fums so advanced and paid into the Exchequer, from the time or respective times of the actual advancing and paying the fame into the Exchequer, until the faid nine and twentieth day of September, one thoufand feven hundred and ten.

No purchase, unless one

XXXIII. And be it further enacted, That it fhall and may be lawful to and for any purchafer or purchafers of any fuch annuity or annuities, as aforefaid, his, her, or their executors, administrators, fucceffors, or affigns, at any time or times, during the continuance of his, her, or their term, eftate, or interest, of and in the fame, by any writing under his, her, or their hands and feals, or under the common feal of a corporation, or by his, her, or their laft will in writing, to affign or devife fuch annuity, or any part thereof, or any intereft therein, to any perfon or perfons whatsoever, and fo toties quoties, and no fuch affignment to be revokable, fo as an entry or memorandum of fuch affignment or will be made in books to be kept for that purpose in the faid office of the auditor of the receipt, within the fpace of three months after fuch alignment or death of the devifor; and that upon the producing fuch affignment or will, or probate thereof, in the faid office of receipt, to be entred, as aforefaid, the party fo producing the fame, fhall bring therewith an affidavit taken before one or more of her Majefty's juftices of the peace, of the due execution of the faid affignment or will, which affidavit fhall be feverally filed in the faid office; which faid entry or memorandum, the proper officers in the said receipt of Exchequer, are hereby required to make accordingly, and to file the faid affidavits; and in default of fuch affignment or devife, by deed or will, the intereft of fuch contributor fhall go to his or her executors or administrators.

XXXIV. Provided always, That no perfon or perfons whatsoever shall or may purchase or obtain, or be admitted to eighth be paid purchafe or obtain any fuch certain annuity or annuities, as before 1 May, aforefaid, for which Exchequer orders are to be made forth, as aforefaid, upon this act, unless the whole or one fourth part at

XXXV. Provided alfo, That in cafe any fuch contributor, Purchafers not as aforefaid, who fhall on or before the faid firft day of May, paying in all one thousand seven hundred and ten, have advanced into the their confideration-money, Exchequer one fourth part of his, her, or their purchase-money, forfeit what is or his, her, or their executors, adminiftrators, fucceffors, or af- advanced. figns, do not advance and pay into the faid receipt of Exchequer, one other fourth part of his or her confideration-money, fo to be paid for fuch refpective annuity or annuities, as aforefaid, on or before the faid first day of July, one thousand seven hundred and ten; and one other fourth part thereof on or before the faid first day of September, one thousand seven hundred and ten; and the remaining fourth part thereof, on or before the faid first day of November, one thousand seven hundred and ten; then, and in every fuch case respectively, no order shall be drawn or figned for fuch refpective annuity, for which the confideration-money fhall not be fully paid, as aforefaid, but fo much of the confideration-money as fhall have been actually paid into the receipt of Exchequer, for such respective annuity, fhall be forfeited to her Majefty, her heirs and fucceffors, and fhall be applied, together with other the monies to be raised by this act, for fuch publick fervices, as aforefaid; any thing in this act contained to the contrary notwithstanding.

XXXVI, And to the end there may be no failure in raifing Within 21 the supply intended to be raised for her Majesty's ufe by this act, May, 1710. it is hereby further enacted by the authority aforefaid, That treafury to within one and twenty days after the faid first day of May, one take an exact thousand seven hundred and ten, at the furtheft, the lord trea- account of all furer, or any three or more of the commiffioners of the treasury for the time being, fhall caufe an exact account to be taken of all the fums of money which fhall, at or before the said first day of May, one thousand seven hundred and ten, be advanced or paid by fuch purchasers, as aforefaid, into the Exchequer, and compute how much by the year the certain annuities which will be payable to such purchasers, their executors, adminiftrators, fuccefors, and affigns (in cafe the refidue of their payments be duly complied with) will in the whole amount unto, and confequently how much (if any remainder be) of the faid yearly fund of eighty one thousand pounds will then remain undifpofed; which account being certified by the faid auditor of the receipt, and clerk of the pells, and allowed by the faid lord treasurer, or any three or more of the commiffioners of the treasury for the time being, fhall be enrolled and recorded in the refpective offices of the faid auditor of the receipt, and clerk of the pells; and publication fhall be made thereof, as well in the London Gazette, as by affixing the fame upon the Royal Exchange in London.
