nalties, forfeitures, and disabilities, and according to fuch rules, methods, and directions, as are prefcribed or appointed by any law or ftatute now in force, for and concerning the duties upon the like coals, culm, and cynders, which have continuance until the thirtieth day of September, one thousand seven hundred and 4 Anna, c. 6. ten, by virtue of the act of parliament made in the fourth year of her Majefty's reign, intituled, An act for continuing an additional fubfidy of tonnage and poundage, and certain duties upon coals, culm, and cynders, and additional duties of excife; and for fettling and establishing a fund thereby, and by other ways and means, for payment of annuities, to be fold for railing a further fupply to her Majefly, for the fervice of the year one thousand feven bundred and fix, and other ufes therein mentioned; and that all and every the powers, authorities, rules, directions, penalties, forfeitures, claufes, matters, and things now in force, contained in the act lastmentioned, or in any other acts or ftatutes thereby referred unto for the governing, managing, raifing, levying, fecuring, collecting, receiving, paying, and accounting for the faid duties upon coals, culm, and cynders, which were granted or continued until the faid thirtieth day of September, one thoufand feven hundred and ten, as aforefaid, fhall be and are, by force and virtue of this present act, revived, and shall be in full force, and be duly obferved, practifed, and put in execution, in and for the governing, managing, raising, levying, fecuring, collecting, receiving, paying, and accounting for the duties upon coals, culm, and cynders, by this act granted, for and during the term hereby granted of and in the fame, and all arrearages thereof, as fully and effectually, to all intents and purposes, as if the fame powers, authorities, rules, directions, penalties, forfeitures, clauses, matters, and things, were again expreffed, and particu→ larly repeated and re-enacted in the body of this present act. Twenty windows to pay ros. additional duty; 30 windows 20s. made perpetual by 3 Gen. 1. c. 8. f. 17. & 5 Geo. 1. c. 19. f. 1. Repealed 20 Geo. 2. c. 3. XI. And it is hereby enacted and declared by the authority aforefaid, That all the faid feyeral duties by this act granted, as feveral duties. well for and upon fuch coals, culm, and cynders, as upon fuch houfes, as aforefaid, fhall be liable to, and be charged and chargeable with the yearly fund herein after mentioned, and all the annuities to be payable out of the fame, in pursuance of this act, during the whole term of thirty two years herein after expreffed, and all the fame duties (except the neceffary charges before-mentioned) are and fhall be appropriated thereunto, in such manner, that all the monies which thall, from time to time, be or remain due, or in arrear, for or upon the faid annuities, or any of them, or for any arrears thereof (if any such be) fhall, from time to time, in the first place be paid and fatisfied out of

And to the end all the monies arifing by the faid duties The officers upon coals, culm, and cynders, and by the faid duties upon for managing houfes by this act granted, may be duly and certainly raifed and the duties brought into the faid receipt of Exchequer for the purposes at 9 & 10 aforefaid; it is hereby further enacted by the authority afore- w. 3. c. 44. faid, That from time to time, during the continuance of this act, there fhall be appointed fuch and so many juftices of the peace, commiffioners of the cuftoms, receivers general, collectors, furveyors, and other officers, as fhall be proper and neceffary for managing, governing, levying, collecting, receiving, and paying the refpective duties by this act granted, and for keeping and rendring the accounts of the fame; and that the said receivers general, collectors, furveyors, and other officers, who are or fhall be concerned in the raifing, collecting, receiving, and paying the faid respective duties hereby granted, or any of them, and keeping and rendring the feveral accounts thereof, fhall perform their feveral duties therein, as to them refpectively fhall appertain, under fuch and the like penalties, forfeitures, and difabilities, for any offence or neglect therein, or for detaining, diverting, or mifapplying any part of the faid monies, as are prescribed and to be inflicted by virtue of an act of parliament, made and paffed in the ninth year of the reign of his late majefty King William the Third, intituled, An act for raising a fum not exceeding two millions, upon a fund for payment of annuities, after the rate of eight pounds per centum per annum, and for fettling the trade to the Eaft Indies, for the like offence or neglect relating to the duties on falt, and upon ftampt vellum, parchment, and paper, thereby granted or referred unto, or for detaining, diverting, or misapplying any part of the monies, which were granted or appropriated by the act last mentioned,

XIII. And be it enacted by the authority aforefaid, That 135,000l. to yearly and every year during the faid term of thirty two years, be the yearly reckoning the first year to begin from the nine and twentieth fund. day of September, one thoufand feven hundred and ten, the full fum of one hundred thirty five thousand pounds, by or out of the monies to arife by the faid duties on coals, culm, and cynders, and by the faid duties on houfes by this act granted, or any of them, and to be brought into the receipt of the Exchequer, as aforefaid, in cafe the fame fhall extend thereunto, thall be the whole and entire yearly fund; and in case all the monies arifing into the Exchequer, of or for the faid duties, fhall not amount to one hundred thirty five thousand pounds per annum, then the monies fo arifing, fo far as the fame will extend, fhall be part of the yearly fund, for and towards the answering or paying of the annuities herein after mentioned; and in cafe the Deficiency to faid duties by this act granted, fhall at any time or times appear be made good

to be fo deficient or low in the produce of the fame, as that within any one year, to be reckoned, as aforefaid, the faid monies arifing into the Exchequer, for or upon account of the fame duties, fhall not amount to fo much as one hundred thirty five thousand pounds, or to fo much as shall be sufficient to difcharge and fatisfié all the annuities by this act appointed, or intended to be paid, within or for the fame year refpectively, That then and fo often, and in every fuch cafe, fo much as fhall be wanting to make up the faid fund for every or any fuch year, fhall be fupplied and made good, from time to time, out of the first aid to be granted in parliament next after fuch deficiency shall appear, and fhall, from time to time, be transferred thereunto, as soon as the fame fhall be granted.

XIV. And be it further enacted by the authority aforesaid, That it fhall and may be lawful for any perfon or perfons, natives or foreigners, bodies politick or corporate, to contribute for or towards advancing the fum of one million five hundred thousand pounds, for carrying on the faid war, by paying, at or before the first day of September, one thousand feven hundred and ten, to any receiver or receivers to be appointed for that purpose, as is herein after mentioned, the fum of ten pounds, or divers entire fums of ten pounds, upon this act; and that for the raifing the faid fum of one million five hundred thousand pounds, any perfon, who will become an adventurer, shall and may advance the fum of ten pounds, for which fum fo advanced, he, fhe, or they, for thirty two years, fhall be entituled to receive a share or dividend of the said yearly fund, as hereafter is expreffed; and that every adventurer may advance as many entire fumns of ten pounds, as he, she, or they, fhall think fit, and for every such fum of ten pounds so advanced, he, she, or they, is or are to be interested in one lot or share of and in the faid yearly fund.

Managers to examine the books, and deliver them to the receivers, &c. Tickets how to be delivered out. Receivers to re deliver the books, &c. by 12 Sept. 1710. Middle column tickets to be rolled up, and put in a box, marked A. Innermoft to remain in the books. There shall be printed one hundred and fifty thousand tickets, and three thoufand feven hundred and fifty tickets fhall be fortunate; that is to fay, one of them, one thousand pounds yearly; three of them, feverally, five hundred pounds; four of them four hundred pounds, four of them three hundred pounds, four of them two hundred pounds, and twenty of them one hundreds, and thirty of them fifty pounds, one hundred of them twenty pounds yearly, fix hundred and one of them ten pounds, and two thousand nine hundred eighty three of them, feverally, five pounds, yearly; fifty pounds yearly to the first drawn ticket, and fifty pounds yearly to the laft drawn ticket. If 1,500,000l. be not paid in, then the fund to be proportionable to the fum advanced. Blanks to have 14 s. per annum for 32 years. The manner of drawing the tickets. Managers to adjudge to whom the fortunate tickets belong. Forging tickets felony. Fortunate to be paid their advantages half yearly. Unfortunate to be paid yearly, at the feast of St. Michael. Eight pounds per cent. allowed for prompt payment. A transfer office to be kept in London. Money lent tax-free. Half yearly and yearly payments to be made in course. XXXIX. And whereas a doubt may arife whether coals, culm, or Coals, &c. cynders carried from the bridge of Sterling, which is on the firth of carried from Forth, to the town of Dunbar, are liable to the duties by this act Sterling to impofed, as if they were carried to fea; it is hereby provided, enacted, and declared, That fuch coal, culm, and cynders, fo carried from the bridge of Sterling to the town of Dunbar, or to any part betwixt them, fhall not, by reafon of fuch carriage, be liable to the duties by this act impofed; any thing in this act contained to the contrary notwithstanding.

An act for employing the manufacturers by encouraging the confumption of raw filk and mohair yarn.

WHEREAS the maintenance and subfiftence of many thousands

of men, women, and children, within this kingdom of Great Britain, depends upon the making of filk, mohair, gimp, and thread buttons and button holes with the needle, and great numbers of throwfters, twifters, fpinners, winders, dyers, and others, are employed in preparing the materials of which fuch buttons and button holes are made; and whereas the filk and mohair wherewith the faid buttons and button holes are made, is purchased in Turkey and other foreign parts, in exchange for the woollen manufacture of Great Britain, to the great confumption thereof; and for the encouragement of fuch numerous manufacturers and manufactures, an act was made in the tenth year of the reign of his late majesty King William the Third, of glorious memory, intituled, An act to prevent the making or felling buttons, made of cloth, ferge, drugget, or other stuffs or materials, under the forfeitures therein mentioned; but that the intended encouragement by the faid act, has, in a great measure, been rendred ineffectual, by a late and unforeseen practice of making and binding of button holes with cloth, ferge, drugget, or other stuffs, to the great difcouragement of and abatement in the confumption of raw filk and mohair yarn, and the utter ruin of numerous families, who ufed to manufacture the faid materials, if not speedily prevented: for remedy whereof, and making the faid recited act of parliament more effectual, be it enacted by the Queen's moft excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That from and after the After March five and twentieth day of March, one thousand seven hundred 25, 1710. and ten, no taylor or other perfon or perfons whatfoever, with- None fhall in the kingdom of Great Britain, fhall make, fell, fet on, ufe or any buttons bind, or caufe to be made, fold, fet on, used, or bound on any or button clothes, or wearing garments whatsoever, any buttons or button holes made on holes made of, or used, or bound with ferge, drugget, frize, bound with

camlet, or any other stuffs of which clothes and wearing garon forfeiture ments are ufually made, upon forfeiture of the fum of five of 51. for eve- pounds for every dozen of fuch buttons or button holes fo made, ry dozen, &c. fold, fet on, ufed, or bound, or caufed to be made, fold, fet on, One moiety to the Queen, the ufed, or bound, as aforefaid, and in like proportion for any leffer other to him quantity; one moiety thereof to be to the ufe of her Majesty, who will fue, her heirs and fucceffors, and the other moiety thereof to him, her, or them that shall fue for the fame, by action of debt, bill, plaint, or information, in any of her Majefty's courts of record, wherein no effoin, protection, or wager of law, or more than one imparlance fhall be allowed: or upon complaint to any two justices of the peace of the county, riding, divifion, city, or town corporate, where the matter in controverfy arifeth, who are hereby impowered to fummon and examine witneffes on oath concerning the fame, and levy the penalty in this act mentioned, and return the overplus, if any be, to the owner or owners thereof; but in cafe any perfon fhall think himself aggrieved by any judgment or order of the faid juftices, it shall and may be lawful for fuch perfon to appeal against the judgment and order of the faid two juftices to the juftices of the peace in the general quarter feffions of the peace, which fhall be held for the fame county, riding, divifion, city, or town corporate, next after notice of fuch order of the faid two juftices; and the juftipowered final- ces of the peace in the faid general quarter feffions are hereby ly to deterimpowered to fummon and examine witneffes on oath, and to mine the mathear and finally determine the matter of the faid appeal; and in The appellant cafe the fame juftices in the faid general quarter feffions shall give judgment against fuch appellant, then the fame juftices fhall award and order to the party, on whose behalf the fame appeal is determined, fuch reafonable cofts and charges to be paid by fuch appellant, in regard of fuch appeal, as to the fame juftices fhall feem meet. And this act shall be taken and allowed in all courts within this kingdom as a publick act and all judges, juftices, and all other perfons therein concerned, are hereby required as fuch to take notice hereof, without fpecial pleading the fame. This act is altered and farther enforced by 4 Geo. I. c.7. And by 7 Geo. 1. flat. 1. c. 12. f. 1. the penalty of forty fhillings per dozen is laid on the wearer.
