CA P. XIV.

An alt for affigning a place proper for holding a market in the city of Weftminster, in lieu of the ancient market place called the Round Woolftaple; and for regulating the faid market.

HEREAS the market for the city of Westminster, bath, from ancient times, been held from or under the dean and chapter of the collegiate church of Saint Peter, Westminster, by their leffee, of the office of keeper and fweeper of the faid market, in a place called the Round Woolftaple, in the parish of Saint Margaret, in the faid city of Westminster; which market place hath been Lately purchafed by the commiffioners conflituted and appointed by divers ftatutes for building a bridge cross the river Thames, from the Woolftaple, or thereabouts, in the parish of Saint Margaret, Weftminfter, to the of pofite fhore in the county of Surry, for the fum of eight hundred and forty pounds; and the faid ground hath been converted by the faid commiffioners to the publick ufe of widening the ftreets leading to and from the faid bridge, according to the directions of the faid ftatutes: and whereas it is neceffary for the accommodation of the inhabitants of the faid city of Westminster, that the said market should be held in fome other convenient place; and the most convenient place for that purpose is within the bounds and limits hereafter defcribed; that is to fay, between the place called the Broad Sanctuary, in the parish of Saint Margaret in the faid city of Westminfter, and Bow Street in the faid parish: and whereas the ground and foil within the faid limits, or the greatest part thereof, is the freehold of the faid dean and chapter, and by them leafed out for terms of years to their tenants; and that the faid dean and chapter would be willing and defirous, for the accommodation of the inhabitants of the faid city, that the faid fum of eight hundred and forty pounds fhould be applied in buying in fuch leafes or terms of years as are out-ftanding, and in purchafing fuch other eftates as might be necessary for holding the faid market within the faid limits, in cafe fuch application of the faid money was not reftrained by the faid acts of parliament made for the building the faid bridge, whereby the faid money is directed to be laid out in the purchase of eftates in fee fimple: and whereas other difficulties may arife in the purchase of fuch ground as may be neceffary for holding the Said market, within the limits aforesaid, by reafon of legal disabilities which the owners or occupiers of fuch ground may be under to difpofe of the fame to the faid dean and chapter for the purposes aforefaid; which difficulties cannot be removed but by authority of parliament; be it therefore enacted, &c.

The commiffioners may extend the limits of the new market within the open space of the Broad Sanctuary, fo far as a line from the gateway of Green's Alley, to the front of the houfe on the east of the way from the Broad Sanctuary into the Little Sanctuary, will admit. fits thereof. No provifions to be fold within 100 feet of the bounds of the market, without licence, under penalty of 51. Juftices may mitigate_the penalties. Perfons aggrieved may appeal to the quarter feffions. Proceedings not to be removed by Certiorari. If any perfon refuse to treat, the commiffioners are to iffue out a warrant to the high bailiff to return a jury, to view the places in question, and to affefs upon oath the recompence. Commiffioners to give judgement thereon. 20 days notice to be given to the parties interested, before fuch affeffment. The verdicts, &c. to be entered in the register's office of the county of Middlesex, &c. Up. on payment or tender of the purchase-money, the dean and chapter may enter on the premisses, and convert the fame into a market. No leafes to be for less than the rents heretofore paid for the market in the Round Woolftaple, &c.

CAP. XV.

An act for taking down feveral buildings, and inlarging the Streets and market places in the city of Gloucefter. WHEREAS the trade and inhabitants of the city of Gloucefter have of late years greatly increased: and whereas, in the four chief freets of the faid city, commonly called Eaftgate Street, Weftgate Street, Northgate Street, and Southgate Street, and where the markets are ufually kept, there are feveral old houses or tenements, falls, and buildings, fome of which fland in the middle of the faid fireets, and the rest of them jet out, project, and are extending irregularly beyond the range or fides of the faid ftreets, towards the middle thereof refpectively; whereby the area of, or places used for the markets of the faid town are greatly ftraitened and confined, and the paffage of carriages, horfes, cattle, and perfons, in and through the fame, is very much obstructed, and rendered difficult and dangerous ; and whereas by taking down the feveral houfes or tenements, ftalls, and buildings aforefaid, the faid fireets will be greatly opened, and rendered much more commodious for the paffage of carriages and foot pallengers, and for the holding and keeping the fairs and markets, and carrying on the trade and bufinefs of the faid city; and the owners of fuch houses or tenements, falls, and buildings, or the greatest part of them, are willing to fell and difpofe of the fame, in order that they may be taken down for the purposes aforefaid: but as feveral of the faid houses or tenements, falls, and buildings, and the fite and foil of the fame refpectively, belong to, and are the eftates and property of ecclefiaftical and other incorporated bodies, femes covert, infants, and others, who by law are difabled to make an abfolute fale and conveyance thereof in fee-fimple, the fame cannot be applied and disposed of for the purposes aforefaid without the aid and authority of parliament; May it therefore please your Majefty, that it may be enacted,

be redeemed according to the tenor or true meaning of the provifo or condition herein after-mentioned in that behalf; so as Cahier of the fuch cashier or cashiers do firft give fecurity to the good liking bank to give fecurity. of any three or more of the commiffioners of his Majefty's treafury now being, or of the high treasurer, or commithioners of the treafury for the time being, for duly anfwering and paying into the receipt of his Majefty's exchequer, for the publick use, the money fo to be advanced or contributed, and to account duly for the fame; which annuities before-mentioned shall be computed at the rate of three pounds per centum per annum for every one hundred pounds, and proportionably for any greater fum fo to be advanced or paid; and the purchase money for every fuch annuity, at the rate aforefaid, is hereby appointed to be paid to the faid cafhier or cashiers, as aforefaid, at or before the refpective days or times herein after limited; that is to Times of payfay, ten pounds per centum, part thereof, on or before the twentieth day of April, which thall be in the year of our Lord one ment of the contribution thoufand feven hundred and fifty; fifteen pounds per centum, other part thereof, on or before the twentieth day of June then next enfuing; twenty five pounds per centum, other part thereof, on or before the eighteenth day of August then next enfuing; twenty five pounds per centum, other part thereof on or before the eighteenth day of October then next enfuing; and the remaining twenty five pounds per centum, on or before the eighteenth day of December then next following: all which annuities fo to be purchased, fhall not exceed in the whole the fum of thirty thousand pounds per annum, and fhall commence from the feaft day of the annunciation of the bleffed Virgin Mary, which fhall be in the year of our Lord one thousand feven hundred and fifty, and thall be paid and payable in the manner, and at the refpective feast days herein after-mentioned; that is to fay, the first payment thereupon fhall be made for the three quarters of a year, which will be due thereupon, computed from the feast of the annunciation of the blessed Virgin Mary, in the year one thousand seven hundred and fifty, to the feast of the birth of our Lord Chrift then next enfuing, and the fubfequent payments half-yearly, at the feafts of the nativity of Saint John the Baptift, and the birth of our Lord Chrift, or within fix days after every of the faid feaft days; and that the first of the faid half-yearly payments fhall be paid at the feast of Saint John the Baptift, which fhall be in the year of our Lord one thousand seven hundred and fifty one, or within fix days after the faid feaft day; nevertheless the faid annuities fhall be redeemable according to the purport and true Cafhier to give meaning of a provifo or condition herein after contained in that behalf, and not otherwife: and the faid cashier or cashiers of the faid governor and company for the time being, is hereby authorized and required, upon the advancing and paying to him or them any fum or fums of money, as aforefaid, forthwith to give a receipt in writing figned by himfelf or themselves, for each which fhall be payment, to the contributor or payer thereof; which receipts affignable; thall be affignable by indorfement thereupon made, at any time before the eighteenth day of December, one thousand seven hun
