shall be directed, to the intent that the interest and annual produce, arising from the money fo to be placed out, may be applied for the purposes herein-after mentioned; and that the faid court of chancery may, by order or orders of the faid court, from time to time, change the fecurity or fecurities on which the faid monies thall be fo placed out, as the faid court fhall think expedient. VII. And be it further enacted, That the intereft and annual

money arifing produce which fhall arife or be produced from fecurities, to be by the fale of purchased in pursuance of this act, with money arifing by fale of the faid pre- the faid ground and premifes, fhall, from time to time, be received by the governor and company of the bank of England, paid to the fix and placed to the credit of an account, to be raised in the books of their cham-kept there for the fuitors of the faid court, of interest arifing bers, &c. from money placed out in purfuance of this act, and fhall from time to time be paid, by virtue of any order or orders of the said court, to the faid fix clerks, and their fucceffors, in lieu and recompence of the chambers fo belonging to their several offices, and for the purpose of keeping the faid offices to be erected in pursuance of this act in proper repair, and what fhall be fo ordered to be paid to the said fix clerks fhall be considered as a freehold estate in them respectively, as coming in lieu of their faid chambers.

Provifo with VIII. Provided always, That from fuch time as the lord high refpect to the chancellor of Great Britain, lord keeper or lords commiffioners iffuing of mo- for the cuftody of the great feal for the time being, fhall deem the purposes of the faid recited act, and of this act, so far as refpects the funds provided by the faid recited act to be fully fatisfied, and fhall in teftimony thereof, by an order of the faid court, declare the fame, and direct the accountant-general of the faid court not to iffue any draft, and the governor and company of the bank of England not to iffue any further fum or fums of money out of the funds provided by the faid recited act for any of the purposes aforefaid, the appropriation by the said recited act herein-before made, and of the furplus money placed to the account of intereft arifing from monies placed out in pursuance of the faid act of the twelfth year of his late majefty King George the Second, and of the furplus money placed to the account of intereft arifing from monies placed out in purfuance of an act of the fifth year of his prefent Majefty, and alfo of the intereft of fecurities to be purchafed pursuant to the faid act of the fourteenth year of his prefent Majefty, thall from thenceforth ceafe and be at an end.

IX. Provided always, and be it further enacted, That no cafement, privy, or house of office whatfoever, be erected on any part of either of the pieces or parcels of ground herein-before defcribed above the level of the ground foor of the faid offices; and that no building whatfoever be erced on the last-mentioned piece or parcel of ground to rife above the level of the springing of the arches in the fronts of the buildings, intended to be erected by the faid fociety, or within thirty feet of the weftern boundary of the faid laft-mentioned ground; and alfo, that the faid

laft-mentioned ground be inclofed on the western boundary by an open iron pallifade railing only, and those parts of the eastern boundary not built against be inclofed by a wall, the top of the coping of which shall be on a level with the fpringing of the faid arches; and alfo, that the external plan and elevations of the basement and ground story of the buildings to be erected on the faid pieces or parcels of ground do correfpond with the buildings intended to be erected by the faid fociety; and that the chimney fhafts be erected regularly, and be carried up to fuch heights as not to annoy or be offenfive to the rooms or chambers in the faid buildings intended to be erected by the faid fociety; and that no act or thing be done upon any part of the said several premises to annoy or be offenfive to any of the faid chambers, or the occupiers thereof.

XI. And it is hereby further enacted and declared, That the The offices faid offices or buildings, to be erected in pursuance of this act, and buildings and the offices or buildings to be erected adjoining thereto, for to be erected the ufe of the register and accountant-general of the faid court ject to the reof chancery, and all other buildings already erected, or begun, gulations of or which may hereafter be erected or begun, or any part of the 14 Geo. 3. ground or premises of Old Lincoln's Inn, fhall not be fubject to all or any of the regulations and directions contained in an act of parliament, paffed in the fourteenth year of the reign of his prefent Majefty, intituled, An act for the further and better regulation of buildings and party walls; and for the more effectually preventing mifchiefs by fire within the cities of London and Westminster, and the liberties thereof, and other the parishes, precincts, and places, within the weekly bills of mortality, the parishes of Saint Mary le Bon, Paddington, Saint Pancras, and Saint Luke at Chelsea in the county of Middlefex; and for indemnifying, under certain conditions, builders and other perfons against the penalties to which they are or may be liable for erecting buildings within the limits aforefaid contrary to law; any thing in the faid act contained to the contrary notwithstanding.

An act for watering Piccadilly, from the end of Berkeley Street to Hyde Park Gate, in the parish of Saint George Hanover Square, in the county of Middlefex.

An act for extending the duty of two pennies Scots, or one fixth part of a penny fterling, payable on every pint of ale and beer vended or fold in the village of Port Glasgow and the privileges thereof, over the town of Newark; for fupplying the inhabitants of Port Glasgow and Newark with fresh water; for paving, cleaning, lighting, and watching the streets of the faid two towns; for erecting publick markets therein; for repairing, and keeping in repair, the breast and east and weft quays of the harbour of Port Glasgow, and other purposes therein mentioned.

An act for draining and preserving certain fen lands, low grounds, and commons, in the feveral parishes of Ramsey, Bury, Wiftow, Warboys, Somersham, Colne, and Pidley with Fenton, in the county of Huntingdon, and in the parishes of Chatteris and Doddington, within the Isle of Ely, in the county of Cambridge.

Preamble. Lands defcribed. So much of former acts as relates to the lands under this act repealed. Fen lands, &c. to be under the controul of the commiffioners under this act. Provifo defcribing the lands to be under the controul of commiffioners till Wimblington Leam,&c. be widened,&c. Provifo. Lands before defcribed to be two diftricts for embanking. Lands divided into five districts for drainage. First diftrict for draining. Second district for draining. Third diftrict for draining. Fourth district for draining. Fifth diftrict for draining. Commiffioners for the general embankment. Number of commiffioners for the lower diftrict. Commiffioners dying, new ones to be chosen. Perpetual commissioners. Qualification of commiffioners. Real owner of two commonable houses, or ten acres of feveral land in upper diftrict, may appoint a commiffioner for every houfe, and 15 acres, over and above which he poffeffes. Commiffioners for draining. Commiffioners for the firft diftrict; strict; third district; fourth district ; owner of 40 acres of taxable land in the first district may appoint a commiffioner for every sò acres over and above which he poffeffes. Every owner of 30 acres within the second district may appoint a commiffioner for every 50 acres over and above which he poffeffes. Each deputy to be owner, &c. of 10 acres in fecond diftrict. Lords and ladies of manors of Warboys, Little Ravely, &c. in the third district, may appoint commiffioners, &c. Every owner of 40 acres in the fourth district may appoint a commiffioner for every 50 acres over and above which he poffeffes; every fuch deputy to be owner of 10 acres. Every owner of two meffuages, or 20 acres, to appoint a commiflioner for every two meffuages and 20 acres over and above which he poffeffes; every deputy to be owner of one mesfuage, &c. Names of the deputies for the five diftricts to be inrolled one month before they act. Time and place of meetings of commiffioners.

Power of adjournment, &c. Commiflioners to rate and affefs upper and lower districts, not to exceed 1 s. per acre in upper diftrict, nor 3 s. per acre in lower district. Taxes to be paid at places commiffioners fhall appoint, &c. Charges of this act how to be paid. Power to lay 6 d. an acre mote for payment of the charges of the act, if neceffary. Time and place of meetings of commiffioners for draining. Commiffioners impowered to affefs the districts in certain fums above the fums directed to be levied on the upper and lower diftricts. Commiffioners of Ramsey firft diftri&t impowered to lay further rates, for repairing of mills, and for payment of debts. Commiffioners of first district impowered to lay a tax of 10s. per acre, and commiffioners of fecond district a tax of zos. per acre, in the first year. Tenants for life, guardians, trustees, &c. may charge their lands for paying the taxes; and may mortgage or leafe fuch lands as a fecurity, &c. Commiffioners impowered to borrow money upon the credit of the rates. The fums to be borrowed in each district. Affignments to be numbered, but none to be made for any lefs fum than sol. in each district. Securities may be affigned. Rates chargeable with the payment of the principal money and intereft. On default of payment, rates shall vest in the creditors till paid. No money to be borrowed at any meeting, unless the proper number of commiffioners for each district fhall be prefent. Debts due to John Gardner etquire, to have priority of payment. Money due to John Waddington and John Gardner efquires, to be paid firft out of the rates within the fifth diftrict. Part of the debts under Sutton and Mepal acts,chargeable upon the lands taken from the controul of the commiffioners under the faid acts. Commiffioners may inclofe part of Warboys commons. How the money arifing from letting fuch inclotures is to be applied. If the money arifing from letting of the inclofures is infufficient to pay the rates, the uninclosed parts liable to the remainder. If tenants refuse to pay their rents at the times mentioned in their leafes, commiffioners may recover by diftrefs. If commiffioners of third district neglect to inclofe the commons, for 3 months, their powers, &c. vefted in the commiffioners of the upper diftrict. Provifo. Grounds fo inclosed not to pay tithes,&c. Rates upon Crollode common by whom to be borne. Part of Somersham common to be inclofed. How the taxes laid on Chatteris common may be recovered. Collectors may diftrain for payment of taxes. If (ufficient diftress cannot be found on the lands, the property of perfons making dev fault may be diftrained in any other place; and if the money rated be not paid within five days, the goods may be fold. Tenants to pay taxes, and deduct the fame out of their rent. Persons refusing to pay the rates for one month after due, to forfeit two-pence in the fhilling for what is in arrear. Commiffioners impowered to collect arrears of taxes under former acts of parliament. Commiffioners may take earth to fupport the banks, &c. and may cleanse, widen, and make cuts, drains, &c. making fatisfaction to the owners of the foil. Difputes to be fettled by the juftices, whose determination fhall be final. In cafe of any breach, &c. banks may be altered. Commiffioners of the lower diftrict for embanking, together with commiffioners for the Three Hundred Acre Farm, to cut drains, erect mills, &c. Commiflioners of lower diftrict to make particular drains. New drains to be begun next to the Forty Foct River. Commiflioners of upper and lower districts to make staunch doors in Slade Load Drain, at the hard lands in Chatteris. Penalty on persons opening the faid doors when hut, without an order figned by commiffioners. Commiffioners impowered to lay taxes on the lower district for carrying on the said works, over and above all other taxes, not exceeding 10s. the first year, nor 2s. in any other year, per acre. The ftile on Northey bank to be kept in repair by the commiffioners of the upper diftrict for embanking. Commiffioners for first district to make drains, and erect a mill. Proprietors of lands adjoining may erect doors next the faid drain for letting the waters into the fame. No water to be conveyed into the faid drain between the said farm and Paddock drove, nor into the divifion ditch between the faid farm and the lands of Mrs. Kerrich. Mr. Flemming to fupport his banks. Penalty of gol. on cutting any of the banks. Commiffioners of first district to stop up the dike ends between Mr. Flemming and Mrs Kerrich's lands, and to erect files as fences, Commiffioners impowered to erect mills and make VOL. XXXI. drains in the fecond district. A drain to be made, and mill erected, for draining Warboys comnion. Commiffioners of the third district to place a ftaunch door or doors in the ditch which divides Mrs. Kerrich's land. and the Weft Water. If commiffioners of third district suffer ftaunch doors to remain open more than two hours before the mill is going, &c. to pay double damage. Any person having the care of ftaunch doors, and fuffering them to continue open more than two hours, &c. to be committed. Owners may fhut the ftaunch doors, &c. and keep them and the banks in repair, if commiffioners refufe; and be paid their expences by the treasurer of the third diftrict. No land of Mr. Wyldbore to be cut or taken for repairing banks, except for the general embankment. Mr. Wyldbore's and Mr. Flemming's land, and Crollode Common, not fubject to drainage tax. Commiffioners of fourth diflrict may erect mills next Fenton load. Commiffioners of fifth district to erect infide mills for drainage, &c. Owners of the Three hundred Acre Farm may erect mills at their own expence. No infide mills permitted to go till the great mills are ready for working, nor during any breach, &c. of the bank, or when the great mills are dilabled from going. 51. penalty for offending. Commiffioners of Sutton and Mepal acts to drain the Three hundred Acre Farm till certain works are completed. Owners to drain, if commiffioners refufe. If one great mill be difabled, half of the others to cease going, &c. Proprietors of adjacent lands may lay tunnels into Fenton Load and the Twenty Feet Drain. Commiffioners of the lower district for embanking, &c. to make a bank from Warboys Common to the Three hundred Acre Farm. Proprietors of Warboys High Fen to make a bank from a place oppofite the Twelve Feet Drain to Wilthorn Ware. Commiffioners of fourth and fifth diftricts may lay tunnels to let waters out of the Forty Foot into the Twenty Feet Drain, Chatteris Commoners to erect a bridge in Chatteris Acre Fen. Monies advanced towards carrying on the works in the upper or lower district for embanking to be repaid out of the taxes arifing or laid in the first year. Commiffioners to order a furvey and map to be made. High lands not to be charged. Manner of determining which are high lands. Perfons deftroying the works deemed guilty of felony. Perfons cutting the works to forfeit 100l. Penalty on perfons laying obftructions in drains and fisheries. Penalty on perfons allowing hogs to wander on the banks. Perfons burning the banks by careieffness, to make good the damage. No hods to be cut within 40 feet of any banks, except in the third diftri&t Perfons erecting horfe mills, or any more mills than directed by this act, to forfeit 50 1. and 51. per day while fuch erections shall continue. No houfes to be built, nor trees, &c. planted, nearer to mills than 50 poles, under the penalty of 100l. Trees and holts now growing within so poles may be cut down. If owners, &c., neglect to fcour or repair dikes, the fame to be done at their expence. Commis fioners annually to view and repair fuch works as fhall be neglected in any of the faid districts. Treasurer of any diftrict where default shall be to pay all the expences. On neglect of the commiffioners for the district where any breach thall happen commiffioners of the other district may repair the fame. Mills to be enfured. No banks, &c. to be taken away till the mills are ready to work. Commiffioners to appoint officers, and allow them falaries. Officers may be removed after 5 days notice. Treasurer and other officers to give fecurity. Officers to account yearly at the general meeting, and to attend with their books, &c. Accounts paffed and allowed, to be entered in two separate books, &c. Officers of each diftri& to account as often as required; and in cafe of neglect to be committed. Proceedings to be entered in books. Orders not to be reversed, unless a certain number of commiffioners be pretent, and the major part confenting thereto, nor unless 10 days notice he given. Juftices may adminifter oaths; and may act although commiffioners, except where perfonally interested. Proceedings not to be removed by Certiorari, &c. Plaintiffs recovering to have full coits, &c. No plaintiff (hall recover if tender of Amends has been made. Penalties how to be recovered. Perfons aggriev ed may appeal to the quarter feffions. Orders not to be quafhed for want of form.
