An act to explain and amend an a&t, made in the fourteenth year of bis prefent Majefty, intituled, An act to amend an act, made in the twenty-fecond year of the reign of his late majesty King George the Second, intituled, An act for the more effectual preventing of frauds and abuses committed by persons employed in the manufacture of hats, and in the woollen, linen, fuftian, cotton, iron, leather, fur, hemp, flax, mohair, and filk manufactures; and for preventing unlawful combinations of journeymen dyers and journeymen hot preffers, and of all perfons employed in the said several manufactures; and for the better payment of their wages.

HEREAS by an act, made in the fourteenth year of the reign of his prefent Majefty, (intituled, An act to amend an A& 14 Geo. 3. act, made in the twenty-fecond year of the reign of his late majesty King George the Second, intituled, An act for the more ef fectual preventing of frauds and abufes committed by persons employed in the manufacture of hats, and in the woollen, linen, fuftian, cotton, iron, leather, fur, hemp, flax, mohair, and filk manufactures; and for preventing unlawful combinations of journeymen dyers and journeymen hot prefers, and of all perfons employed in the faid feveral manufactures; and for the better payment of their wages ;) certain penalties therein mentioned are inflicted on perfons convicted of reeling falfe or fhort yarn, but no provifion is made for recovery of the faid penalties, or of the costs and charges attending fuch profecutions, by means whereof the good purposes intended by the faid att are rendered ineffectual; may it therefore please your Majefty that it may be enacted; and be it enacted by the King's most excellent majesty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament assembled, and by the authority of the fame, That from and after the paffing of this act, the feveral pecuniary penalties inflicted by the faid act upon perfons who fhall be convicted of reeling false or fhort yarn, together with the cofts and charges attending fuch profecutions, fhall (in cafe the fame are not paid according to the order of the juftice or juftices before whom fuch person or perfons shall be so convicted) be levied by distress and fale of the goods and chattels of the offender or offenders, by warrant or warrants under the hand and feal, or hands and feals, of the justice or justices before whom fuch offender or offenders shall be fo con

II. HEREAS in and by an act, made in this prefent feffion of Preamble. parliament, intituled, An act for punishing mutiny and desertion, and for the better payment of the army and their quarters, feveral regulations are made and enacted for the better government of the army and their observing strict discipline, and for providing quarters for the army and carriages on marches and other neceffary occafions, and inflicting penalties on offenders against the fame act, and for many other good purposes therein mentioned; but the fame may not be fufficient for the forces that may be employed in his Majefty's dominions in America: and whereas, during the continuance of the faid act, there may be occafion for marching and quartering of regiments and companies of his Majefly's forces in feveral parts of his Majefty's dominions in America, and whereas the publick houses and barracks in his Majesty's dominions in America may not be fufficient to Jupply quarters for fuch forces: and whereas it is expedient and neceffary that carriages and other conveniences upon the march of troops in his majefty's dominions in America fhould be supplied for that purpofe, be it enacted by the king's most excellent majefty, by and VOL. with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That for and during the continuance of this act, and no longer, it fhall and may be lawful to and for the conftables, tithingmen, magiftrates, and other civil officers of villages, towns, townships, citics, diftricts, and other places, within his Majesty's dominions in America, and in default or abfence, for any one juftice of the peace inhabiting in or near any fuch village, township, city, diftrict, or place, and for no others, and fuch conftables, tithingmen, magiftrates, and other civil officers aforesaid, are hereby required to quarter and billet the officers and foldiers in his Majesty's fervice in the barracks provided by the colonies; and if there fhall not be fufficient room in the faid barracks for the officers and foldiers, then, and in fuch cafe only, to quarter and billet the refidue of fuch officers and foldiers (for whom there shall not be room in fuch barracks) in inns, livery ftables, alehoufes, victualling-houfes, and the houfes of fellers of wine by retail to be drank in their own houses or places thereunto belonging, and all houses of perfons felling of rum, brandy, ftrong waters, cyder, or metheglin, by retail, to and if there be be drank in houses; and in cafe there fhall not be fufficient room alfo infuffici- for the officers and foldiers in fuch barracks, inns, victualling ent, then in and other publick alehouses, that in fuch and no other cafe, and hired uninhabited houses, upon no other account, it shall and may be lawful for the go&c. vernor and council of each refpective province in his Majesty's dominions in America, to authorife and appoint, and they are hereby directed and impowered to authorife and appoint, fuch proper perfon or perfons as they fhali think fit, to take, hire, and make fit, and in default of the faid governor and council appointing and authorifing fuch perfon or perfons, or in default of fuch person or perfons fo appointed neglecting or refusing to do their duty, in that cafe it thall and may be lawful for any two or more of his Majesty's juftices of the peace, in or near the faid villages, towns, townships, cities, diftricts, and other places, and they are hereby required to take, hire, and make fit for the reception of his Majefty's forces, fuch and so many uninhabited houfes, outhouses, barns, or other buildings, as fhall be neceffary to quarter therein the refidue of fuch officers and foldiers for whom there should not be room in fuch barracks and publick houses, as aforesaid, and to put and quarter the refidue of fuch officers and foldiers therein.

III. VI. VII. Provided nevertheless, and it is hereby enacted, That the officers and foldiers fo quartered and billeted as aforefaid, (except fuch as fhall be quartered in the barracks and hired unininhabited houses, or other buildings as aforefaid,) fhall be received, and furnished with diet, fmall beer, cyder, or rum mixed provifions at with water, by the owners of the inns, livery ftables, alehouses, certain rates. victualling-houses, and other houfes in which they are allowed to be quartered and billeted by this act, paying and allowing for the fame the several rates herein-after mentioned, to be payable out of the fubfiftence-money, for diet and fmall beer, cyder, or rum mixed with water.

VIII. Provided always, That in cafe any innholder, or other perfon, on whom any non-commiffion officers or private men fhall be quartered, by virtue of this act, in any of his Majesty's dominions in America, (except on a march, or employed in recruiting, and likewife except the recruits by them raised for the fpace of feven days at moft, for fuch non-commiflion officers and foldiers who are recruiting, and recruits by them raised,) fhall be defirous to furnish fuch non-commiffion officers or foldiers with candles, vinegar, and falt, and with small beer, or cyder, not exceeding five pints, or half a pint of rum mixed with a quart of water, for each man per diem, gratis; and allow to fuch non-commiffion officers or foldiers the use of fire, and the neceffary utenfils for dreffing and eating their meat, and fhall give notice of fuch his defire to the commanding officer, and thall furnish.
